Welcome to RP SMS, a bulk SMS & WhatsApp messaging service owned and operated by RP Graphics.

By accessing or using our website, dashboard, API or any of our messaging services, you agree to be bound by these Terms & Conditions. If you disagree with any part of these terms, you may not use our services.

1. Service Description

RP SMS provides transactional, promotional & OTP bulk SMS services, WhatsApp Business API messaging, DLT registration support, and related communication solutions through various telecom operators in India.

2. Eligibility

You must be at least 18 years of age and legally capable of entering into contracts to use our services. Businesses/organizations must be duly registered under applicable Indian laws.

3. DLT / TRAI Compliance

• All promotional SMS must be sent only through registered templates on DLT platforms.
• Customers are solely responsible for getting their Sender ID, templates and content approved on all required DLT portals.
• RP SMS acts only as a messaging gateway and is not responsible for delays/rejections in DLT registration or template approval.
• Any penalty/fine imposed by TRAI/DoT/Telcos due to violation of regulations shall be borne solely by the customer.

4. Content Responsibility

You agree that:

• You will not send any unlawful, harassing, defamatory, obscene, harmful, misleading, phishing or fraudulent content
• You will not send messages promoting illegal activities, betting/gambling (unless explicitly permitted by law), adult content, political/religious hatred, or pyramid schemes
• You are solely responsible for the content of all messages sent through your account

5. Refund & Payment Policy

• All SMS credits are non-refundable except in cases of proven technical failure from our end.
• Partially used credits are non-refundable.
• No refund shall be provided for messages blocked/rejected by telecom operators or DLT platforms due to template/content violations.

6. Account & Security

• You are responsible for maintaining the confidentiality of your account credentials.
• You agree to notify us immediately of any unauthorized use of your account.
• We reserve the right to suspend/terminate accounts involved in suspicious or fraudulent activities without prior notice.

7. Service Availability & Limitation of Liability

While we strive to provide 99.9% uptime, we are dependent on telecom operators, DLT platforms, and TRAI regulations. We shall not be liable for:

• Delivery delays/failures caused by telecom operators
• DLT/template rejections
• Force majeure events (natural disasters, government actions, etc.)
• Indirect, consequential, or punitive damages

8. Termination

We may suspend or terminate your account immediately, without prior notice if:

• You breach these terms
• You send spam or prohibited content
• We receive complaints from authorities or telecom operators
• Your account remains inactive for more than 12 months

9. Governing Law & Jurisdiction

These terms shall be governed by the laws of India. Any dispute arising out of or in connection with these terms shall be subject to the exclusive jurisdiction of courts in Bhubaneswar, Odisha only.
